1. Who You're Contracting With

Ash Ledger ("Ash Ledger", "we", "us", "our") is owned and operated by Alexander Joseph ("Seller"). By creating an account or using the Ash Ledger service (the "Service"), you enter into a binding agreement with the Seller.

2. Acceptance

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

3. Eligibility

You must be of legal smoking age in your jurisdiction to use the Service. You represent that you have authority to enter into this agreement and that the information you provide is accurate.

4. The Service

Ash Ledger is a personal cigar journaling and palate-training application. We offer a free tier and a paid Premium tier with additional features such as unlimited entries, more photo uploads, and AI-generated pairing recommendations.

5. Acceptable Use

You agree not to misuse the Service, including but not limited to:

  • Using the Service for any unlawful purpose, fraud, or spam.
  • Infringing on the intellectual property rights of others.
  • Uploading malware, probing or scanning the Service, or scraping content.
  • Interfering with or disrupting the Service or its security features.
  • Sharing or reselling your account credentials.

6. Account Credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

7. User Content

You retain ownership of the tasting notes, photos, and other content you upload ("User Content"). You grant the Seller a limited, non-exclusive license to host, process, and display your User Content solely to operate the Service for you.

8. Intellectual Property

The Seller retains all rights in the Service, including the software, design, branding, and documentation. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan. You may not reverse engineer, resell, redistribute, or circumvent technical limitations of the Service.

9. AI Features

The Service uses AI models to generate pairing suggestions and other content. AI outputs may be inaccurate or incomplete and are provided for educational and entertainment purposes. They are not professional advice. You are responsible for your prompts, for how you use AI outputs, and for verifying any information before acting on it. You must not use AI features to generate illegal content, hate speech, deepfakes, malware, or to attempt to jailbreak the model. We may moderate, filter, or refuse AI outputs and may suspend accounts that repeatedly misuse AI features.

10. Payments, Subscriptions & Tax

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms and our Refund Policy.

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel anytime; access continues until the end of the current paid period.

11. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, you may export your User Content for a reasonable period before it is deleted.

12. Warranties & Service Level

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific needs. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

13. Limitation of Liability

To the maximum extent permitted by law, the Seller's aggregate liability arising out of or relating to the Service shall not exceed the fees you paid in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

14. Indemnification

You agree to indemnify and hold the Seller harmless from claims arising out of your User Content, your misuse of the Service, or your breach of these Terms.

15. Discontinuation

We may discontinue the Service or any feature at any time. If we discontinue paid plans, we will give reasonable advance notice and a window to export your data.

16. Governing Law

These Terms are governed by the laws of the Seller's jurisdiction, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.
